This is the first SCOTUS case in decades to clarify the State’s obligations under Napue, which established that the State violates the defendant’s Due Process rights when it knowingly allows any false testimony to be presented at trial. Understanding Glossip, and the case law that precedes it, will empower appellate and trial lawyers alike to stop the State from letting witnesses lie, mislead, or avoid admitting the truth.
